So back in 2023 I complained to the SCOTUS overlord for the Eighth Circuit – the Hon. Brett Kavanaugh. He actually responded to my complaint (or his minion did) and told me that I wasn’t able to appeal their denial to the SCOTUS in 2023. Then in January of this year (2026), the SCOTUS made it possible for me to appeal the denial, so I’m doing that today.
I argue that the Eighth Circuit has put me into an unconstitutional Kafkaesque loop. In sum, the government is withholding information – along with Joseph Leo Howard – that would exonerate me. (A peculiar side note as of the date of this post is that Howard isn’t listed on the Our Attoneys page of his law firm…) Anyway, the Eighth Circuit refused to accept the strong circumstantial evidence that I provided proving that fact – (Even though the government uses circumstantial evidence to convict people “beyond a reasonable doubt” all the time). As I’ve documented, Howard has refused to provide anything from my case file and the government has heavily redacted Exhibit H. I argue that those two facts and the Eighth Circuit’s opaque posture has put me into a constitutionally untenable Kafkaesque situation.
In other words, both Howard and the government are willfully (knowingly) withholding exoneration information. I argue to the SCOTUS that both acts are blatantly corrupt AND I focus on the obtuse denial from the Eighth Circuit. They denied my petition without explaining why. This is Kafkaesque because by not explaining why they denied my petition, they make me guess as to why it was denied. I argue that’s unconstitutional because it denies my right to Habeas Corpus as a meaningful way to address my grievances against the government. To make it more broad, I contend that this opaqueness should be rejected by the SCOTUS. I argue that they should force the Circuit Courts to spend the time and write one or two more sentences stating why a Habeas Petition fell short. I argue that this is constitutionally required when the petition is extensive and the government responds with perfunctory procedural arguments instead of addressing the substance of the factual claims.
Bottom line, Howard is corruptly protecting his Bar Card & the government is corruptly protecting the integrity of Operation Torpedo.
